For 2012 the Adoption Tax Credit is $12,650.00. Unfortunately the credit is no longer refundable as it was in 2010 and 2011. If you are unable to use all of the credit in tax year 2012, you can carry the credit forward for up to five years. If you are adopting a special needs child, you are entitled to claim the full amount of the credit, even if you have no adoption related expenses. The tax credit begans to phase out if your modified adjusted gross income is $189,710.00 and is is unavailable if your modified adjusted gross income is $229,710.00.

Legislation has been introduced to again make the tax credit refundable, and to extend it beyond tax year 2012. There is no way of determing if this proposed legislation will pass. I certainly urge anyhone who is interested to contact your Congressman or Senator to voice your support for adoption tax credit.
